Dog/Puppy Sales
Agreement and Health Guarantee
THIS AGREEMENT
Between_____________________(Buyers)
and D1 Kennels (Seller) is effective as of the date of the last signature to
appear below and is binding upon both parties thereto. Buyer(s) agree to buy and
the Seller agrees to sell the below described dog/puppy pursuant to all the
following terms:

FOLLOWING TERMS:
Agreement:
Dog/Puppy is purchased for Companion/Breeding. Buyer will receive full
registration papers. Buyer agrees to have dog’s hips certified with a rating of
fair or better to remove limited registration status. Buyer shall be responsible
for any cost incurred in pursuit of full registration. Seller does not guarantee
the testis to drop on male dog sold as companion. The seller will not pay
additional cost to spay or neuter any dog sold. If the dog is purchased as a
companion and the buyer and seller agree at a later date that this dog is
suitable for breeding the buyer agrees to all fees incurred in the pursuit of
full registration.
Health Guarantee:
Seller will provide vaccination record to buyer and guarantee the health of said
dog for three calendar days from date it leaves the possession of the Seller.
The dog, if shipped, comes to you with a veterinarian’s health certificate and a
record of vaccinations. We recommend that you take the dog to your own
veterinarian (at the Buyer’s expense) within the first three days for your own
satisfaction and protection. If you have other dogs, we also suggest you place
the new dog in quarantine during this time and follow the advice of your
veterinarian for length of quarantine. You, or your Veterinarian, shall report
to the Seller any medical problems within the guarantee period. If the dog is
found to have a medical problem it must be reported to the Seller within
twenty-four (24) hours of its discovery. Failure to make this report within this
time frame will void this guarantee.
Refunds,
Replacements and Expenses: There Shall be no refunds of purchase price, shipping
charges or other costs. There shall be replacement of the dog with a dog of
equal value only under the following circumstances provided below.
1)
If the dog is found to be in unsound health with a life threatening incurable
disease or virus by a licensed veterinarian within three calendar days, the dog
shall be returned to the Seller or euthanized at the buyer’s expense upon
approval of the Seller. The replacement will be made as soon as a suitable
replacement becomes available. A medical report signed by the examining
veterinarian must be provided to the Seller prior to a replacement being made.
There shall be no replacement unless under the Health Guarantee (within three
calendar days period only except as stated below). The seller will not replace
any dog that has not received adequate and appropriate care from its new owners.
It is the responsibility of the buyer to provide immediate veterinary care (at
the Buyer’s expense) to any dog showing signs of illness or distress and failure
to do so will render this guarantee null and void. Under no circumstance is the
dog to be destroyed prior to notification by the Buyer to the Seller. Any dog
for which the Buyer expects replacement must be returned to the seller (at the
Buyer’s expense) so that identification of the dog can be verified. “Unsound
Health” shall be defined as any condition, which is life threatening or
incurable, and shall not include curable conditions but not limited to
infections such as colds, virus, bacterial infections or skin rashes.
The Buyer assumes
responsibility of all expenses incurred in relation to the dog after the dog
leaves the possession of the Seller, as well as any expense incurred at the
request of the Buyer before the dog leaves possession of the Seller. If for any
reason the dog is returned to the Seller, Buyer agrees to pay all expenses,
including shipping cost, mileage and re-examination expense of Seller’s
Veterinarian.
Vaccinations:
Your dog has been given the required vaccination series due at the age the dog
at time of purchase. All remaining vaccinations are the responsibility of the
Buyer.
Shipping:
All costs are to be paid by the Buyer, when purchasing a dog that must be
shipped. Shipping costs will include all cost incurred by the Seller including
buy not limited to carrier, health certificate, transportation costs. Specific
shipping arrangements will be determined in advance and confirmed by both
parties. This signed agreement must be returned prior to dog being shipped.
Housing, Care and Transfer to Third Party: Buyer agrees that
this dog will be kept in his/her own yard and not allowed to roam freely outside
of Buyer’s yard. Under no circumstances will the dog be sent to a shelter or
otherwise disposed of, nor shall this dog be sold, leased or given away to any
pet shop, research laboratory, or similar facility. If the Buyer wishes to
resell, give away, or is unable to or no longer desires to care for this dog,
the Buyer must confirm with Seller’s first right of refusal to purchase said dog
or return the dog to seller at Seller’s expense. Buyer agrees that Seller has
the right to retrieve said dog if Seller does not adhere to all provisions of
this contract or if the dog is being neglected or abused.

I, Vincent Butler, take a deposit of the amount
stated above, on the puppy named above. The deposit is a Promise to buy the
puppy and a Promise to hold the puppy. If for any reason the buyer changes his
or her mind on the puppy they picked out, they can pick another puppy when one
is available. If they choose not to pick another puppy, they will lose the
deposit they put down. You have a 72 hour Health Guarantee to have pup Checked
by Licensed Vet. If the pup does not pass, you may pick another pup with equal
value.
Pups that are shipped have been checked by a licensed Vet and
will have a Health
certificate. Puppy will come with the First Puppy Shot and
Worming.
Puppy must be paid in full by 6 to 7weeks of age, unless
other arrangements have
been made. If pups aren’t payed in full by 7 weeks of age I
have the right to put the puppy back on the market for resale or it’s a $25 late
fee charge for every week held. That option varies between arrangements made by
both parties. Your money will not be refunded only transferred to another puppy
of your choice.
Price of Pup does not include health certificate, Air Fare,
or Shipping Crate cost.
Shipping is an Additional $300-$400 depending. The deposit is
Non-refundable. All pups are sold with registration papers. ¦The
Purchaser has read and fully understands the terms of this contract and agrees
to comply with them.
